The Will of Elnathan Nye



ELNATHAN NYE (Ebenezar,4 Benjamin1), born in Falmouth, Mass., he married December 23, 1731, Mary Wing. Served as Selectman in 1730. He died March 5, 1772, leaving no children.

Will of Elnathan Nye:

In the name of God Amen, I Elnathan Nye of Sandwich in the County of Barnstable being advanced in years and under Indisposition of body but in perfect mind and memory. Do make this my last Will and Testament hereby making null and void all former will or wills by me made Committing my Soul to God According to the merciful Tenor of the Gospel of his son Jesus Christ and my body to the Grave to have a decent burial & as to my worldly

Estate my will is and I Do hereby dispose of and Give it in manner following.

Imprimis. My Will is that my Just Debts and funerall expenses be first paid by my Executor hereafter named.

Item, I Do hereby order out of my Estate a comfortable support and maintenance for my beloved wife to be provided for her During her life by my Executor hereafter named in Lieu of her Dower.

Item. I Give and bequeath to my Nephew Solomon Nye his heirs and assigns forever all my Estate both Real and Personal of what kind or nature soever & is in consideration of his faithful service towards me he performing the before named duties and I Do hereby constitute & appoint him the said Solomon sole Executor of this my Last Will and Testament In Witness whereof I have hereunto set my hand and seal this eighteenth day of June A. D. 1762.
